Booking Terms & Conditions

Hey there, and thank you for choosing The Salty for your yoga and surf retreat in Portugal or Sri Lanka. By making a booking with us, you acknowledge and agree to the following terms and conditions. Please read them carefully before confirming your trip.

​

1. Booking & Payment
To confirm your spot, a deposit of 50–100% is required at the time of booking. The remaining balance is payable upon check-in. Easy and secure.

 

2. Cancellations & Refunds
You may cancel your booking up to 7 days before your scheduled arrival date. After this time, cancellations are no longer eligible for a refund. Applicable processing fees apply to all eligible refunds.

 

3. Changes to Bookings
Booking changes may be possible, but restrictions apply—particularly for requests made within 7 days of your arrival. All change requests are subject to availability and approval.

 

4. Travel Insurance
We strongly recommend obtaining personal travel insurance to protect against unforeseen events. We do not provide insurance, and unused portions of your stay or activities are non-refundable.

 

5. Early Check-Outs
Departing early or missing scheduled activities does not entitle you to any refund or credit. Please plan accordingly.

 

6. Third-Party Reservations
If you booked via a third-party platform, their cancellation and deposit policies apply. All other terms and conditions in this Agreement remain fully enforceable.

 

7. Late Check-In
Check-in must be completed by 22:00. If your arrival is delayed, contact us in advance to avoid complications.

 

8. Adults-Only Policy
Our retreats are designed for adults aged 16 and over. Younger guests may only be accommodated with prior written approval from management.

 

 

General Information 

These Terms and Conditions (the "Agreement") apply to all participants (the "Traveler") attending a yoga and/or surf retreat organised by The Salty (operated by Salty Pelican Lda) in Portugal or Sri Lanka, whether booked with or without an activity package.

For the purposes of this Agreement, the following definitions apply:

  • "Activities": Refers to all services and experiences offered at The Salty retreat locations, including but not limited to yoga classes, surf lessons, guided meditation hikes, wellness treatments, and other optional add-ons. These may be operated by The Salty or through verified partners, affiliates, or subcontractors.

  • "Travelers": Refers to any individual who books, confirms, or participates in a Package Tour, activity, or retreat experience provided by The Salty, whether individually or as part of a group. This term includes all guests staying at The Salty locations, regardless of booking channel or package type.

  • "Agreement": Refers collectively to these Terms and Conditions, your Booking Confirmation, and any other documents or policies provided by The Salty in connection with your booking.

  • "Booking Confirmation": The written or electronic confirmation issued by The Salty once a booking is accepted and confirmed. This document outlines your reservation details, retreat dates, and associated services.

  • "Website": Refers to the official online presence of The Salty at www.thesalty.co

  • "Package Tour": Refers to the comprehensive retreat package offered by The Salty, which may include accommodation, yoga and/or surf sessions, equipment, wellness treatments, meals, and additional services or experiences as specified in the package details.

  • "Terms": The binding booking terms and conditions as outlined in this Agreement.

 

2. Booking

2.1 By completing a booking for a retreat package (hereinafter referred to as a "Package Tour") with The Salty, you confirm that you have read, understood, and fully agreed to be bound by these Terms and Conditions.

2.2 A booking becomes contractually binding only upon issuance of a Booking Confirmation by The Salty, following your booking request and confirmation of participation. Until this confirmation is received in writing, no contract shall be deemed in effect.

2.3 If you are making a reservation on behalf of one or more additional participants, you warrant that you are authorised to act on their behalf. As the designated booking contact, you accept full responsibility for the accuracy of all information provided, payment of all sums due, and communication of all updates or changes related to the booking.

2.4 Traveler under the age of 16 are not permitted to book or attend any retreat at The Salty unless prior written consent is obtained from management. Participation of minors is subject to approval and discretion of The Salty’s retreat management team.

2.5 If your reservation is part of a group organised through a third party, additional terms as stipulated in the organiser’s agreement may apply. It is the sole responsibility of the organiser to ensure that all members of the group are aware of and agree to these terms.

2.6 For administrative and logistical purposes, group organisers will receive full guest list information, including booking references and contact details, for all participants within their party.

2.7 Before issuing any invoice to a designated group organiser, The Salty will share the applicable privacy policy, terms and conditions, and relevant contractual details for approval.

2.8 By confirming your booking, you and all members included in the reservation expressly accept these Terms and Conditions, as well as the applicable Data Protection Policy and the Package Travel Agreement made available during the booking process.

2.9 Where bookings are made by or through a group organiser, that individual or entity assumes responsibility for communicating and enforcing these Terms on behalf of all guests included under the group reservation.

3. Traveler’s Obligations

3.1 Each Travelers is solely responsible for ensuring they possess a valid passport, as well as any visas, vaccinations, health documentation, or other entry requirements necessary for travel to the retreat destination. The Salty bears no responsibility for denied entry due to incomplete or invalid travel documentation.

3.2 All Travelers are required to obtain personal travel insurance that adequately covers medical treatment, injuries sustained during activities, cancellation, lost luggage, and damage to or theft of personal belongings. The Salty accepts no liability for loss, theft, or damage to personal property—howsoever caused or sustained—whether on or off the premises.

3.3 The Traveler is responsible for independently arranging and booking all transportation to and from the retreat destination. Travelers must ensure all personal details provided, including nationality and passport information, are accurate and current for compliance with border, customs, and legal travel requirements.

3.4 Upon receipt of the Booking Confirmation, the Traveler must review all booking details for accuracy. Any discrepancies must be reported to The Salty immediately. The Salty will not be liable for costs resulting from inaccuracies not promptly communicated.

3.5 Travelers are responsible for informing The Salty of any changes to their contact information, including phone number and email address, that may impact booking communications or updates.

3.6 Guests are expected to behave with respect and consideration for fellow guests and staff. Disruptive, aggressive, or inappropriate behaviour—whether verbal or physical—will not be tolerated. The Salty reserves the right to terminate services, refuse entry, or remove individuals whose conduct compromises the safety, comfort, or enjoyment of others, without refund.

3.7 Key Card/Wristband Policy: Upon check-in, all guests will be issued a personal RFID wristband or key card granting access to the property, guest rooms, and secure storage areas. This item must be returned at check-out. A replacement charge of €10 will be applied to the final invoice for any lost, unreturned, or damaged wristband/keycard.

3.8 Yoga Mat Policy: Each guest is provided a yoga mat for personal use during their stay. Guests are required to return the mat at check-out. A €70 replacement fee will be charged for any lost, unreturned, or damaged mat, billed either at check-out or post-departure.

3.9 Towel Policy: Upon arrival, guests receive personal towels for use during their stay. Towels must be returned at check-out. Failure to return will incur a €10 replacement charge per towel.

3.10 Tourism Tax: Where applicable by law, Travelers are required to pay a local city tourism tax upon arrival. This fee, such as €2 per person, per night (for up to 7 nights), is collected directly at check-in and will not be included in the invoice or prepayment. Guests must settle this tax in accordance with the local municipality’s policy at the destination.

3.11 External Visitors and Overnight Guests
Access to The Salty is strictly limited to registered guests. Visitors are not permitted on the property—including participation in yoga classes, meals, or use of facilities—without prior written approval from the on-site manager. Overnight stays by non-registered individuals are strictly prohibited. If a guest is found to have allowed an unapproved overnight visitor, a penalty equal to the full nightly package rate or where applicable nightly room rate, will be charged. Repeat or serious violations may result in immediate termination of the stay without refund.

These rules are in place to protect the safety, comfort, and experience of all guests.

4. Rates and Payment Information

4.1 All details provided in our brochures, catalogues, or digital listings form an integral part of this Agreement. These are binding unless otherwise stated, and may be subject to change with reasonable notice provided to the Traveler before booking confirmation.

4.2 The total price for a Package Tour will be clearly stated and inclusive of all agreed services. This includes any mandatory national or foreign taxes, charges, or service fees, with the exception of any applicable local city tourism tax.

4.3 For online bookings, payment is accepted via credit or debit card. All bookings require a 50% deposit at the time of booking using a valid credit/debit card. The remaining 50% must be settled at check-in on the first day of the retreat. A 3% processing surcharge applies to all card payments made on-site. For convenience, an ATM is located nearby from The Salty or at the airport prior to arrival.

4.4 The Salty reserves the right to pre-authorise or charge any remaining balance prior to arrival or after departure. In cases of non-payment at check-in or mid-stay, and where the guest departs without settling the balance, The Salty may charge the outstanding amount plus applicable processing fees (3%) to the card on file without further notice.

4.5 Group bookings may be paid via invoice. A non-refundable deposit of 50% of the total cost is required immediately upon booking to secure the reservation. The remaining 50% must be paid no later than 30 days before the arrival date. All group bookings remain provisional until full payment is received and are subject to cancellation until confirmed.

4.6 For group bookings made less than 30 days prior to arrival, full payment is due at the time of booking. Reservations are not considered final until payment is processed in full.

4.7 For promotional long-stay bookings (typically one month or more), full payment is required at the time of booking. These rates are non-refundable and non-transferable under any circumstance.

4.8 Special arrangements included in the Agreement are only valid when marketed and sold in conjunction with the primary retreat package, whether at a bundled or separately itemised price.

4.9 Any additional services requested by the Traveler are only deemed included once confirmed in writing by The Salty. Any associated fees or discounts must be documented and approved as part of the booking confirmation.

4.10 In the event of payment delay, a reminder will be issued with an additional administrative fee and a revised payment deadline. Continued non-compliance may result in the matter being forwarded to debt recovery services or legal action. Please note: All bookings constitute a legally binding agreement, and payment is required unless a valid written cancellation is submitted in accordance with our cancellation policy.

4.11 If payment is not received within the agreed timeframes outlined above, The Salty reserves the right to cancel the booking and reallocate the space to another customer without further notice.

5. Flexible Booking Policy

5.1 The Salty offers a flexible cancellation policy allowing a full refund for all Package Tours and bookings if cancelled at least 7 days (168 hours) before the scheduled arrival date (not the check-in time). To qualify, cancellation must be submitted in writing and include the booking name, retreat dates, and location. The cancellation must be received no later than midnight (local time), seven days before the scheduled arrival date.

5.2 Refund requests must be sent to cascais@saltypelicanretreats.com. Approved refunds will be processed within 14 business days from the cancellation confirmation and are subject to a 3% processing fee, which covers non-refundable administrative and banking costs.

5.3 Cancellations received less than 7 days (168 hours) before the arrival date are not eligible for a refund. The 50% deposit becomes non-refundable and non-transferable to alternative dates or retreat locations.

 

6. Price Adjustments

6.1 The Salty reserves the right to adjust the price of any Package Tour or booking after confirmation in the event of unforeseen cost increases. These may include, but are not limited to: Changes in transportation costs (e.g., fuel prices), Amendments to taxes, duties, or levies imposed by national or foreign authorities and Supplier-imposed fee increases related to included services.

6.2 Any such price change will reflect only The Salty’s proportional share of the additional incurred cost.

6.3 No price adjustments will be made within 20 days of the guest’s scheduled arrival date. Should an adjustment be necessary, we will notify the traveler in writing with full transparency as soon as possible.

7. Package Tour Transfer

7.1 A Traveler may transfer their Package Tour or booking to another individual, provided that the transferee meets all eligibility requirements outlined in these Terms and Conditions and is deemed suitable to participate in the retreat. A €25 administrative transfer fee will apply. The Salty must be notified of the transfer within a reasonable period prior to the scheduled arrival. Transfers are subject to availability and may be restricted if the requested dates, room type, or package inclusions are not available.

7.2 The original Traveler and the transferee are jointly and severally liable for any outstanding payments, applicable transfer fees, or additional charges incurred as a result of the transfer.

 

8. Changes Requested Prior to Arrival

8.1 Changes to retreat dates or duration are not permitted within 7 days (168 hours) of the scheduled arrival date. However, a downgrade from a Package Tour to a bed and breakfast stay is permitted if requested no later than 7 days prior to arrival. Downgrades to shorter stay durations must also be requested at least 7 days in advance of the originally scheduled retreat week.

8.2 While The Salty offers free cancellation up to 7 days before arrival, modification requests within the 7-day period—including changes to arrival dates, duration, or package type—will not be accepted, regardless of the reason (e.g., illness, travel delays). Guests still have the option to cancel entirely within the 7-day window in accordance with our cancellation policy.

8.3 Any change to a Package Tour outside of the 7-day window may result in price differences due to seasonal rates or updated package pricing. Travelers will be informed in advance of any resulting cost adjustments.

8.4 Name changes for guests listed on a booking are permitted only if the full payment has been completed in advance. The booking remains the financial responsibility of the original payer. The Salty is not liable for any internal agreements or disputes between the original and replacement Traveler.

8.5 For promotional Long-Stay bookings (i.e., approximately one month or more), no changes to dates or length of stay are permitted within four weeks of the scheduled arrival. Modifications may incur penalties or lead to the loss of reserved nights.

8.6 Promotional codes must be applied at the time of booking by the Traveler. Codes cannot be added retroactively by The Salty’s team under any circumstances.

 

9. Changes or Cancellations Made by The Salty Before Arrival

9.1 The Salty reserves the right to amend, reschedule, or cancel any Package Tour prior to arrival if it becomes impossible or impractical to deliver the experience as described due to operational, legal, or logistical reasons. In such instances, guests will be notified promptly.

9.2 If such changes result in a material increase or decrease in the value of the retreat, the Traveler will be entitled to either an upward or downward price adjustment (as applicable), except where the changes are minor and do not substantially alter the retreat experience.

9.3 In the case of a material breach of the Agreement by The Salty, the Traveler may choose to:

  • (a) Cancel the Agreement and receive a full refund, or

  • (b) Accept an alternative retreat of comparable value, subject to availability.

9.4 Travelers must notify The Salty within a reasonable time if they intend to terminate the Agreement due to any substantial changes. Failure to notify within the specified period will result in forfeiture of the right to cancel or claim a refund.

9.5 If the alternate Package Tour offered by The Salty is of lesser value than the original, the Traveler will receive a partial refund for the difference.

10. Changes Made by The Salty After Arrival

10.1 In limited cases, The Salty may be unable to deliver certain pre-agreed services following guest arrival due to unforeseen external factors. These may include, but are not limited to, natural conditions, operational disruptions, staff illness, supplier changes, political unrest, or local government restrictions. Should this occur, The Salty will make reasonable efforts to offer a comparable alternative only where appropriate and possible. If a service of material value is cancelled and cannot be delivered or substituted during the guest’s stay, compensation may be offered at the discretion of The Salty in the form of partial credit or refund, excluding surf-related inclusions (see 10.4).

10.2 The Salty reserves the right to amend or cancel any ongoing retreat experience if necessary due to safety concerns, severe operational limitations, or other exceptional circumstances. In such instances, affected guests will be informed of the change and offered options to either accept the revised itinerary or terminate the remainder of their stay. Refunds, if applicable, will be limited to the unused portion of the retreat. For clarity, this does not include dissatisfaction related to weather conditions, such as rain, wind, or flat ocean swell, which are natural and cannot be guaranteed or controlled.

10.3 No compensation or substitute services will be provided for changes due to force majeure events or third-party disruptions. These include, but are not limited to, extreme weather, strikes, transportation delays, natural disasters, or sudden changes by service providers beyond our control.

10.4 Surf Activity & Equipment Policy: Surf conditions are subject to natural fluctuation and cannot be guaranteed. In the event a scheduled surf lesson must be cancelled due to weather or safety concerns, The Salty will make efforts to reschedule the lesson during the guest’s stay if time permits. However, if the guest is unable or unwilling to reschedule (e.g., due to early check-out or conflicting plans), no refund, rescheduling outside the stay, or alternative activity will be provided. Likewise, no compensation or alternative service will be offered for unused days of surfboard rental, regardless of weather, swell, illness, or personal availability. Guests booking surf-inclusive packages acknowledge these limitations and accept them as part of the retreat’s natural variability.

 

11. The Traveler’s Right to Cancel The Package Tour or Booking 

11.1 Travelers may cancel their Package Tour or booking at any time by submitting a written request via email to cascais@thesalty.co Cancellations must be received no later than 7 days (168 hours) prior to the scheduled arrival date (measured from midnight the day before arrival date) to be eligible for a refund, minus a 3% non-refundable administration fee.

11.2 The cancellation date is determined by the date the request is received by The Salty. Cancellation outcomes are as follows:

  • Cancellation received ≥ 7 days before arrival: Eligible for full refund minus 3% processing fee.

  • Cancellation received < 7 days before arrival: The 50% deposit is non-refundable and will be retained.

11.3 Long-Stay Bookings: Promotional bookings of approximately one month or more are offered at a non-refundable rate. Guests choosing to cancel these bookings acknowledge and accept that no refund will be issued under any circumstances.

11.4 The Salty strictly prohibits the cancellation and rebooking of confirmed reservations—under the same, similar, or false names—for the purpose of accessing new or discounted promotional rates. Such conduct is considered misuse of our flexible policy. In such cases, original booking terms and pricing will remain enforceable, and any promotional discount on the new booking will be void. Deposits paid toward rebooking will not be refunded. However, at our sole discretion, we may allow a one-time transfer of the second deposit to the original booking. This transfer is final, non-refundable, and exempt from the standard 3% processing fee. All bookings must match valid passport ID at check-in. Failure to present matching, verifiable ID may result in immediate cancellation without refund.

12. The Salty’s Right to Cancel the Retreat 

12.1 The Salty reserves the right to cancel any confirmed retreat package or booking if payment terms, including deposits or agreed payment plans, are not adhered to. To ensure timely registration, payments must be made by credit or debit card and processed in our system by the specified due date.

12.2 For group bookings on a payment plan, payments made via bank transfer must be initiated at least 7 days prior to the payment deadline to account for standard processing delays. Failure to meet the deadline may result in cancellation of the booking without notice.

13. Force Majeure 

13.1 For the purposes of this Agreement, "force majeure" refers exclusively to unforeseeable, extraordinary events occurring after the booking becomes binding that render it legally or physically impossible for The Salty to fulfil its contractual obligations. Such events may include, but are not limited to, acts of God, natural disasters, war, terrorism, national emergencies, epidemics or pandemics only where government-mandated shutdowns require the closure of The Salty’s facilities. In such cases, guests will be entitled to a refund of payments made, less a non-refundable 3% processing fee to cover administrative and financial transaction costs. No further compensation or damages shall be payable.

13.2 For the avoidance of doubt, government travel advisories, warnings, or recommendations against travel—whether issued by foreign ministries, embassies, or international agencies—shall not be considered force majeure unless they result in formal, binding legal restrictions that prevent The Salty from operating at the booked destination. If the retreat remains open and operational, standard cancellation and refund terms apply, regardless of third-party travel advice or individual concerns.

13.3 In circumstances where a guest is unable or unwilling to travel due to personal reasons, including but not limited to: voluntary cancellations, personal health concerns, inability to obtain travel documentation, flight cancellations, or changes in visa policy—such matters do not constitute force majeure and shall not entitle the guest to a refund, waiver, or compensation.

13.4 In cases where force majeure does not legally require The Salty to cease operations but materially impacts a guest’s ability or choice to attend, the guest may request a one-time rescheduling of the booking within a 12-month period from the original check-in date. This is offered entirely at the discretion of The Salty, subject to availability, and must be requested in writing. The new dates must be of equal or lesser value, or any price differences will be payable by the guest. This rescheduling right is a courtesy; no monetary refund will be provided.

13.5 Force majeure cannot be invoked for events that were publicly known, ongoing, or reasonably foreseeable at the time the booking was made. By confirming the booking, the guest acknowledges and assumes such risks.

13.6 The Salty shall not be liable for any indirect or consequential losses, including travel or flight disruptions, costs incurred from third-party providers, or missed experiences caused by events outside its control. Travel insurance is strongly recommended to mitigate such risks.

14. Travel Insurance

14.1 The Salty does not provide travel insurance coverage for any Package Tour or booking.

14.2 It is the sole responsibility of the Traveler to obtain comprehensive travel insurance to cover the duration of their participation in the retreat, including but not limited to medical expenses, personal injury, theft, cancellation, illness, or other unforeseen events. Participation is at the Traveler’s own risk. The Salty shall not be held liable for any loss, injury, medical emergency, missed activities, or inability to participate due to illness or accident. No refunds or reimbursements will be issued for unused services or missed activities due to such occurrences. It is the Traveler’s responsibility to secure appropriate coverage and to manage any claims directly with their insurer. The Salty strongly advises consultation with a licensed insurance provider prior to arrival.

 

15. Refunds, Complaints, Claims, and Error Resolution

15.1 If any issue arises with the services provided, the Traveler must notify The Salty immediately during their stay, giving the onsite team or service provider a fair opportunity to address and rectify the situation. Complaints raised only after departure are not eligible for resolution.

15.2 All complaints must be formally documented in writing and submitted during the guest’s stay to the on-site manager or via email to cascais@saltypelicanretreats.com. Failure to provide timely written notice may render any subsequent claim void.

15.3 Claims for refunds, deductions, or damages must be submitted in writing within seven (7) calendar days of the check-out date. Claims submitted after this deadline will be considered waived and are not eligible for compensation.

15.4 In exceptional cases where a defect was not reasonably discoverable during the stay, The Salty may, at its sole discretion, accept claims submitted within two (2) months of the date the issue was or should reasonably have been discovered.

15.5 Where an error or issue is acknowledged and a corrective measure is offered, the Traveler is not entitled to cancel the Agreement or demand a refund if the correction is implemented within a reasonable timeframe and without significant disadvantage to the Traveler.

16. Involvement in Program Activities

 

16.1 Activities offered at The Salty may be provided directly or through verified third-party providers. Where The Salty acts solely as an intermediary, it disclaims all liability for the performance, safety, or quality of such third-party services. Separate terms and liability limitations may apply.

16.2 Participation in all activities is voluntary and undertaken entirely at the guest’s own risk. It is the guest’s sole responsibility to ensure they are medically and physically fit to participate. The Salty does not provide medical advice and is not liable for any adverse outcomes.

16.3 Medical declarations and waiver forms may be required for participation in select activities. Refusal to complete a required waiver or provide medical information when requested may result in denial of participation without refund or compensation.

16.4 The Salty reserves the right to deny participation in any activity, or cancel a guest’s involvement, if their physical or mental condition presents a risk to themselves or others. No refunds shall be due, and all related costs remain the guest’s responsibility.

16.5 The Salty shall not be held liable for weather, ocean, wind, or environmental conditions affecting the provision or quality of scheduled activities. The Salty retains full discretion to modify, postpone, or cancel activities including, but not limited to, surf lessons, surfboard rentals, yoga classes, hikes, or group dinners due to safety, weather, or operational concerns. No refunds, credits, or rescheduling obligations apply under these circumstances.

16.6 If an included activity is cancelled and cannot be reasonably rescheduled during the guest’s booking period, including cases where the guest’s scheduled departure prevents participation, The Salty is under no obligation to provide a substitute, refund, or compensation of any kind. Rescheduling is offered solely at The Salty’s discretion and subject to availability within the original stay dates.

16.7 Surf lessons included in retreat packages are limited to beginner-level (Level 1) group classes only. Intermediate, private, or advanced instruction is excluded and may be arranged onsite at an additional cost, subject to availability.

16.8 Complimentary surfboard use is restricted to guests with eligible package bookings. All other guests must pay standard rental fees. All equipment must be signed out via a waiver, used responsibly, and returned in acceptable condition. The guest is fully liable for any loss, damage, or late return, and charges may be applied to the card provided at check-in.

16.9 The Salty reserves the right to close the surf school and suspend surfboard rentals without notice due to flat conditions, dangerous surf, or operational reasons. No refunds, credits, or extensions will be issued for missed rental use due to such closures.

16.10 All activities included in the retreat package are non-transferable, non-refundable, and may not be exchanged or substituted for alternative services or monetary value under any circumstances.

17. Exemption from Liability and Responsibility 

17.1 While The Salty endeavours to maintain a high standard of safety, service, and guest satisfaction, the Traveler acknowledges and agrees that, to the maximum extent permitted by applicable law, The Salty shall not be liable for any injury, illness, damage, loss, delay, or expense incurred by the Traveler, except where such loss is proven to be the direct result of The Salty’s gross negligence or willful misconduct.

17.2 Without limiting the generality of the foregoing, The Salty expressly disclaims any and all liability for loss, damage, cost, delay, or injury arising from or attributable to:

17.2.1 Acts, omissions, errors, or negligence of third-party service providers or subcontractors, including transportation companies, activity providers, or accommodation services not directly operated by The Salty.

17.2.2 Events or circumstances constituting force majeure, including but not limited to natural disasters, pandemics, government restrictions, strikes, war, civil unrest, or other events beyond the reasonable control of The Salty.

17.2.3 Failure by the Traveler to comply with any requirement, instruction, or obligation set forth in these Terms, including but not limited to timely arrival, behaviour expectations, and participation requirements.

17.2.4 The Traveler’s failure to obtain, maintain, or present valid travel documents, including passports, visas, or medical certifications required for travel or participation in retreat activities.

17.2.5 The Traveler’s disregard of official check-in/check-out times, designated meeting points, or scheduled activity participation times.

17.3 To the fullest extent permitted by law, The Salty’s aggregate liability for any and all claims related to a Traveler’s Package Tour, whether in contract, tort, or otherwise, shall not exceed the total amount paid to and received by The Salty for that individual Traveler’s booking. No consequential, indirect, or punitive damages shall be recoverable.

18. Modification and Alteration of Terms

 

18.1 The Salty reserves the right to modify, amend, or update these Terms at any time without prior notice. All changes will be published on our official website at www.thesalty.co Amended Terms shall take effect 24 hours after publication and will apply to all new and existing bookings. Continued use of our services following any amendments constitutes acceptance of the revised Terms. Travelers may request the current version of these Terms in writing at any time.

19. Validity and Severability

19.1 If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, such provision shall be deemed severed from the remainder of the Agreement, which shall remain in full force and effect. Where necessary, the affected provision will be interpreted or replaced to reflect the parties’ original intent, while preserving enforceability to the greatest extent permitted by law.

20. Standards of Behaviour and Etiquette

20.1 The Salty is committed to fostering a respectful, inclusive, and safe retreat environment for all guests and staff. By joining any retreat, guests agree to abide by the following Code of Conduct:

Respectful Conduct

  • All guests must treat fellow guests, staff, and partners with kindness and courtesy at all times.

  • English is the preferred language to ensure clear and inclusive communication across all locations.

Zero Tolerance for Harassment and Discrimination

  • The Salty enforces a strict zero-tolerance policy for harassment, discrimination, bullying, or any form of abusive conduct based on gender, race, religion, nationality, disability, sexual orientation, or any protected characteristic.

  • Any complaints will be handled seriously, confidentially, and without retaliation. Violators may be subject to immediate removal from the property without refund and reported to appropriate authorities where applicable.

Substance Use

  • Alcohol may be consumed responsibly. Excessive use, disruptive intoxication, or any conduct that threatens safety or comfort is not tolerated.

  • The use, possession, or distribution of illegal drugs or participation in any illegal activity is strictly prohibited and will result in removal without refund.

Retreat Property and Equipment

  • Guests are expected to use all facilities, accommodations, yoga equipment, surf gear, and communal spaces with care. Damage or loss due to negligence or misuse may result in repair or replacement charges.

Communication

  • All forms of communication between guests, staff, and partners must remain respectful and free from hostility, regardless of political views, religion, gender identity, or cultural background.

 

Failure to comply with any portion of this Code of Conduct may result in immediate termination of your retreat participation without refund. If you observe or experience a breach of these standards, please report it to the on-site General Manager or email: cascais@thesalty.co

 

21. Photography, Video & Audio Consent

21.1 By entering any retreat property or participating in any activity organised by The Salty—including but not limited to yoga classes, surf lessons, hikes, group dinners, or other group sessions—you provide irrevocable consent to The Salty and its authorised representatives to film, photograph, or otherwise record your likeness and voice.

21.2 These recordings may be used, at The Salty’s sole discretion, for promotional, commercial, advertising, and editorial purposes across any medium, including digital and print formats, without limitation as to geography or duration.

21.3 You waive any right to inspect, approve, or claim compensation, royalties, or benefits in connection with the use of such materials, and acknowledge that you shall not be entitled to any financial remuneration or credit.

21.4 Participation in our retreats constitutes full agreement with this consent. If you do not wish to appear in such content, you must notify The Salty in writing prior to your arrival; however, The Salty reserves the right to deny any request for exclusion that is deemed unfeasible in group settings or disruptive to operations. No refund, discount, or rescheduling will be offered based on refusal to appear in media captured during standard activities or on premises.

21.5 Guests have no legal right to demand content removal or request alteration of scheduled programming, events, or media creation once onsite. The Salty reserves full editorial and publishing discretion.

23. Legal Jurisdiction and Dispute Resolution

23.1 This Agreement shall be governed by and interpreted in accordance with the laws of Portugal, without regard to any conflict of law principles.

23.2 Any dispute, controversy, or claim arising out of or relating to these Terms, the Agreement, or the services provided by The Salty, shall be subject to the exclusive jurisdiction of the courts of Portugal.

24.3 The competent court of first instance in the district where the primary business establishment of The Salty is located shall serve as the forum for all legal proceedings.
